General Statement of Duties
Performs responsible paralegal work under the general supervision of a Real Estate Commission
Attorney.


Distinguishing Features of the Class
An employee in this class serves as a division paralegal and is responsible for a variety of
assignments which may include but not be limited to drafting, reviewing, and approving for form and
legality various legal instruments; providing litigation support; handling complaints and inquiries of a legal
nature from the general public; administratively maintaining a law office; and performing administrative
database entry and report production. Work includes legal research, as well as research into government,
title, and court records; and generally requires that the employee independently handle certain complex
administrative tasks such as handling more detailed or difficult projects or cases; compiling data for a
variety of required and complex reports; producing reports; and tracking deadlines. Employees may
present findings with preliminary legal analysis subject to attorney review. Work is considered advanced
and requires tact and discretion in handling more technical or confidential matters in the program areas.
Work requires sound judgment and initiative, and a high degree of accuracy and attention to detail.
Work is performed under the supervision of the Director and Assistant Director of Regulatory Affairs and
is evaluated through observation, conferences, and the quality and effectiveness of work completed.


Duties and Responsibilities
Essential Duties and Tasks
Consults the North Carolina General Statutes and agency rules and regulations regularly.


Procedures, precedents, or model legal documents are available for most work assignments, but generally
require some interpretation or modification.


Provides close and direct support to attorneys involved in administrative and civil litigation
connected with the business of the North Carolina Real Estate Commission.


Drafts notices of hearing, routine pleadings, motions and orders in licensing and civil cases.


Coordinates and prepares witnesses, performs research, writes legal memoranda, organizes,
summarizes and prepares physical and documentary evidence, and coordinates discovery in both
administrative and civil litigation.


Researches title to real property, deeds of trust and other documents from Register of Deeds,
property tax records, and civil and criminal court judgments, pleadings, and other state and federal court
records, using both the Internet and paper documents.


Conducts correspondence relating to the above duties and handles multiple cases and tasks
simultaneously.


Writes informational materials on legal topics related to Real Estate License Law, Commission
rules, real estate brokerage, and real estate transactions generally.


Reviews and verifies records and reports for correct information; processes documents based on
review and verification; files and retrieves materials; changes/adds/deletes various database information;
re-indexes information; makes corrections; uploads and imports various documents.


Maintains and updates databases requiring knowledge of and ability to interpret and apply rules,
regulations, and procedures.

Manages time share project registrations, database, and annual renewals of time share projects.


Manages child support revocation cases and acts as liaison to the Division of Social Services.


Types correspondence, briefs and special projects for the Director of Regulatory Affairs and
other attorneys in the Regulatory Affairs Division.


Compiles and generates reports on case status and activity and open files.


Receives and responds to telephone and internet inquiries from licensees and the public.


Assists other professional and administrative staff as needed.

Recruitment and Selection Guidelines
Knowledge, Skills and Abilities
Possesses a full understanding of the paralegal function. Employee is generally given specific
instructions on the goal of each assignment. Work is, generally, reviewed upon completion by the
qualitative assessment of an attorney.


Considerable knowledge of the Administrative Procedures Act, the Rules of Civil Procedure, the
Rules of Evidence, the North Carolina Real Estate License Law and Real Estate Commission rules, and the
statutory and common law governing real estate transactions and real estate brokerage.


Considerable knowledge of standard legal research techniques, both on and off-line.


Working knowledge of case, statutory, and common law.


Some familiarity with the law of estates in land conveyancing and title records.


Working knowledge of judicial and quasi-judicial procedures and the rules of evidence.


Ability to perform legal research in accordance with preliminary instructions as to methods or
approach, source material available, and policy and precedent of the office.


Ability to summarize facts and evidence, and prepare legal instruments.


Ability to communicate clearly and logically in oral and written form.


Thorough knowledge of automated office systems including word processing, spreadsheet design
and usage, and other related resources.


Thorough knowledge of modern office practices and procedures, and ability to use correct
grammar, vocabulary, and spelling.


Knowledge of departmental operations and functions.


Skill in customer service problem-solving and conflict resolution.


Accuracy and attention to detail.


Ability to gather and give basic information and instructions on departmental programs based
upon inquires.


Ability to arrange and place records, reports and files into a proper sequence and develop systems
for retrieval and storage of departmental records.


Ability to gather and compile materials from a variety of sources.


Ability to operate computer, printer, scanner, and other equipment required by the job.


Ability to establish and maintain effective working relationships with the general public,
supervisor, Commission officials, clients and employees.

Physical Requirements
Must be able to physically perform the basic life operational support functions of standing,
walking, fingering, talking, hearing, and repetitive motions.


Must be able to perform sedentary work exerting up to 10 pounds of force occasionally and/or a
negligible amount of force frequently or constantly to lift, carry, push, pull, or otherwise move objects.


Must possess the visual acuity to compile and compute data and statistics operate a computer
terminal, proof read materials, and do extensive reading.


Desirable Education and Experience
Graduation from a certified school for paralegal training and one year of experience as a paralegal;
or graduation from a four-year college or university with a degree in English, journalism, or a degree
directly related to the area assigned and one year of substantive paralegal experience; or graduation from
high school and five years of paralegal experience performing delegated, substantive legal work or an
equivalent combination of training and experience; and courses in related information technology with
considerable administrative and office management experience at a journey level, with some at the
advanced journey level; or an equivalent combination of training and experience.
